NextImg:DOJ says it had ‘cooperating witness’ inside Harvard law journal who now works at White House - Washington Examiner

The Department of Justice told the Harvard Law Review that it had a “cooperating witness” at the paper who has since left to work under White House deputy chief of staff Stephen Miller.

Last month, the DOJ accused the prestigious law publication of destroying evidence during an open investigation into claims of discrimination against white men. The agency also claimed it had a “cooperating witness” working at the journal, a person who was identified by the New York Times as someone who has since moved to work for the Trump administration under Miller.

David Wasserman, as he was identified in letters from the DOJ to Harvard University, was an editor at the student-run journal. The White House confirmed to the outlet that he was offered a job on April 25, the same day accusations of discrimination against white men surfaced at the journal in a report from the Washington Free Beacon. Wasserman’s first day of work under Miller was May 22, and he graduated from Harvard on Wednesday.

The letters were sent May 13, 21, and 23.

During a search for a leaker, editors at the law journal accused Wasserman of downloading tens of thousands of documents and gave him a formal reprimand. The DOJ demanded they retract the disciplinary action against him.

“Prior to Mr. Wasserman’s Harvard Law School graduation, scheduled to take place on May 29, 2025, H.L.R. must retract the disciplinary action it instituted against him,” the May 23 letter read. “Any record of his discipline must be permanently expunged.”

It also ordered the outlet to “retract any instructions to Mr. Wasserman or others to delete responsive documents.”

A senior Trump administration official told the New York Times that Wasserman was eyed for a job well before the DOJ’s investigation into the law journal and that his hiring wasn’t connected. The White House praised him as a good example for others.

“Harvard is violating federal law with its discrimination, and a student was brave enough to call them out on this,” White House spokesman Harrison Fields told the outlet. “Because of his actions, the Justice Department is investigating clear violations of the law.”
