


Democrats who repeatedly said “no one is above the law” when President Donald Trump was indicted in four criminal cases have ironically criticized the indictment against former FBI Director James Comey.
On Thursday, a federal grand jury indicted Comey on one count of making false statements to Congress and one count of obstruction of justice during a congressional investigation. Both charges stem from the former FBI director’s 2020 testimony before the Senate Judiciary Committee about the bureau’s handling of the Trump-Russia investigation.

Democrats were outraged by the latest indictment, with many claiming it poses a threat to democracy.
Sen. Chris Murphy (D-CT) described Comey’s indictment as a “constitutional crisis,” calling on leaders to choose between “democracy or autocracy.”
In February, Murphy also said Trump’s move to dismantle the United States Agency for International Development amounted to the “most serious constitutional crisis the country has faced.” Earlier this week, the senator compared Trump’s treatment of his enemies to “deeply repressive states,” such as Iran or China.
Other Democratic lawmakers made similar statements.
Rep. Jasmine Crockett (D-TX) went on MSNBC late Thursday to speak her mind about Comey’s indictment. The congresswoman claimed any Trump supporters who are in favor of the administration targeting its perceived political opponents are not true Americans.
“How is it that you can call yourself American or patriotic when you literally don’t understand who we are as Americans, when you literally are OK with throwing out the Constitution?” she asked.
Crockett previously said that “not even a former president” was above the law when Trump received his first indictment in March 2023. In that case, he was hit with 34 felony counts for allegedly falsifying business records to conceal hush money payments to pornographic film actress Stormy Daniels nearly two decades ago.
New York Attorney General Letitia James, who brought the state charges and a civil fraud lawsuit against Trump, also said he could not escape justice in those two cases.
James has not commented on Comey’s indictment, but she may be one of Trump’s next targets.
The state attorney general is battling allegations that she committed mortgage fraud by listing more than one home as her primary residence. She was previously referred to the Department of Justice for possible criminal prosecution.
It’s possible James may be charged after Trump teased there would be more indictments coming down.
“There’ll be others,” the president told reporters on Friday. “What they’ve done is terrible, and so I would, I hope there, frankly, I hope there are others because you can’t let this happen to a country.”
Sen. Adam Schiff (D-CA), who is facing mortgage fraud allegations like James, weighed in on Comey’s indictment on social media.
“In my almost six years as an Assistant U.S. Attorney, I never witnessed such a blatant abuse of the department,” he said. “The DOJ is now little more than an arm of the president’s retribution campaign.”
During his time in the House, Schiff was the one who led the first impeachment inquiry into Trump. He was also a member of the House select committee that investigated the Capitol riot on Jan. 6, 2021, weeks before Trump left office at the end of his first term.
Schiff once called for Trump to “be treated like any other lawbreaker.”
Sen. Tim Kaine (D-VA) called Comey’s indictment a “political hatchet job,” arguing the Trump administration is not following the facts in this particular case. Rather, he said the Trump administration is simply exacting retribution against the president’s enemies.
Comey is “entitled to the rule of law,” the senator told MSNBC host Jen Psaki on Thursday. “He’s entitled to fairness. He’s entitled not to be victimized by a clearly trumped-up political persecution.”
When it comes to Trump, Kaine and Psaki were among countless others who have employed the phrase: “No one is above the law.” In their eyes, the same can’t be said for Comey.
Republicans and Trump officials, including FBI Director Kash Patel and Attorney General Pam Bondi, are now co-opting the phrase to be used against Comey and possibly others.
“Everyone, especially those in positions of power, will be held to account – no matter their perch,” Patel wrote on X.
“No one is above the law,” Bondi similarly said. “Today’s indictment reflects this Department of Justice’s commitment to holding those who abuse positions of power accountable for misleading the American people. We will follow the facts in this case.”

The indictment came days after Trump publicly pressured Bondi to use her prosecutorial authority to go after Comey, James, and Schiff.
Comey has maintained his innocence, vowing to fight the allegations in court.
