The only thing more frustrating than waiting in line to pass through security at an airport is watching migrants, without any valid form of identification, skip past you in a special migrant-only security line, as they are yet again given special treatment on the way to their final destination.

President Joe Biden’s decision to create this migrant-identification loophole is a threat to public safety and it needs to stop. That is why Sen. Mike Lee (R-UT) is fighting for an amendment to this year’s Federal Aviation Administration Reauthorization Act that would ban any airline from operating in U.S. airspace if it applies one set of rules for those legally in the country and a separate set of rules for migrants.

Unfortunately, Biden’s migrant-identification loophole is not new. By dismantling President Donald Trump’s effective border security measures, Biden quickly caused a border crisis as migrants from around the world flooded the southern border knowing Biden would release them into the United States.

To help migrants get to their final destinations as quickly as possible, Biden ordered the Transportation Security Administration to accept charging documents issued by Customs and Border Protection agents when they released migrants into the country. Most often these were “Notice to Appear” documents that ordered migrants to appear in an immigration court at a future date.

As Biden’s border crisis got even worse, sometimes the papers issued to migrants by CBP include “Notice to Report” documents that instruct migrants to report to an Immigration and Customs Enforcement office at a later date, and more recently, CBP One Mobile app papers. Importantly, none of the documents issued by CBP to migrants requires an adequate background check. Lee identifies some recent migrants who flew using Biden’s migrant-identification loophole in a letter to colleagues:

“The Biden Administration has aided and abetted aliens like Corey Alvares into this country. Alvarez applied for entry and used the CBP One Mobile App to board a commercial flight to New York City, where he was ultimately arrested for raping a 15-year-old disabled girl. Kenol Baptiste also entered the U.S. using CBP One and has been arrested for illegally committing a double homicide. Mohammed Kharwin, who is on the national terrorist watchlist and is a member of Hezb-e-Islami, also entered the country using the app.”

Migrants released into the United States by Biden rarely have valid passports or other government-issued identification because they often discard them before they illegally cross the border. The motives for migrants ditching their actual government-issued identification vary, but usually it is because the identification is from a safe country they have been living in recently that is not their home country, which is evidence that they do not qualify for asylum protections. Other migrants just don’t want authorities to know their real identities because they have criminal histories. Biden doesn’t care. He just lets them all into the country anyway.

Biden, of course, would never sign Lee’s amendment into law. It would significantly hamper his migrant catch-and-release program. Still, securing a vote on the amendment is crucial because it would at least put all Democratic senators on record supporting Biden’s migrant-identification loophole.
