NextImg:Class-action settlement: Deadline for CVS lidocaine customers to file claim in two days


There are two days for customers who purchased CVS Pharmacy-branded maximum strength lidocaine patches, creams, roll-ons, or spray products to file a claim in a $3.8 million settlement.

Consumers of the various products have alleged that the packaging was deceptive because it led people to believe the product provided a "maximum strength" of lidocaine. CVS Pharmacy had denied any wrongdoing regarding the packaging but has agreed to this settlement to resolve the matter. The deadline to file a claim is Nov. 20.

Eligible customers can submit up to three claims to recover $4.50 per unit without proof of purchase. Those who submit a claim with proof of purchase are entitled to $4.50 per unit, with no limit on how many claims they make. An affected customer may make claims with proof of purchase or without proof of purchase, but not both.

Those who purchased the products from Dec. 11, 2017, through July 18, 2023, are eligible for a piece of the settlement and must submit a claim to receive a payment.

The final approval hearing for the settlement is scheduled for Dec. 19, when affected customers may speak about the proposed settlement with the pharmacy over the lidocaine products. Further information on the settlement, including how to file a claim, can be found on the court-authorized website.

Other class-action settlements with upcoming deadlines to file a claim include one for Capital One customers. The settlement comes after a hacker accessed millions of customers' personal information. Customers who are affected have until Nov. 27 to claim a piece of that settlement.
