


A coalition of conservative policy leaders is calling on the Biden administration to abandon its plans to rewrite Title IX in such a way that would allow biological men who identify as women to compete in girl's sports.
The Defense of Freedom Institute for Policy Studies on Tuesday led a letter to the Department of Education signed by representatives of nearly 30 different conservative policy and advocacy organizations, including representatives from the Heritage Foundation, the Family Research Council, and Parents Defending Education.

"More importantly, if the administration proceeds with its radical re-rewrite of Title IX, it will result in severe harm to biological women and girls and cause them to lose positions on athletic teams, awards, scholarships, and prizes, as well as risk bodily harm in certain sports.”
In 2022, the Department of Education proposed new regulations governing the prohibition of sex-based discrimination in schools to replace a rule implemented by the Trump administration and former Secretary Betsy DeVos. The proposed rule, which is expected to be finalized later this year, expanded the definition of "sex" to include sexual orientation and gender identity and removed a host of due process requirements for students accused of sexual misconduct. The administration declined to apply the proposed rule to athletics and announced it would undergo a separate rule-making process for Title IX protections in sports, which is expected to be released sometime this year.
The coalition letter specifically addresses the anticipated Title IX rule-making process around sports.
"We strongly oppose the Department’s planned issuance of additional rulemaking or further guidance that would force schools, colleges, and universities to implement the Biden administration’s illegal, unfair, and imprudent approach to Title IX, athletics, and gender identity," the coalition letter says. "Such rulemaking would cause enormous harm to female student athletes and reverse decades of progress that have ensured equal athletic opportunities for women and girls attending educational institutions across the United States."
The coalition said any attempt to force schools to allow biological men who identify as women into women's sports programs exceeded the department's statutory authority and required congressional action.

An Education Department spokesperson told the Washington Examiner the department "look[s] forward to responding directly to the authors of the letter.”
