A federal appeals court ruled in favor of allowing President Donald Trump’s “Liberation Day” tariffs to stay in place while it reviews a lower court’s decision to block them.

The U.S. Court of Appeals for the Federal Circuit in Washington, D.C., released its ruling on Tuesday, saying it was of “exceptional importance” to have the 11-member court rather than the typical three-judge panel hear the appeal. The hearing is set for July 31.

The appeals court will review the May 28 ruling by a three-judge panel of the U.S. Court of International Trade that determined Trump exceeded his authority by implementing his sweeping tariff agenda through the International Emergency Economic Powers Act. Enacted in 1977, this law grants the president the power to regulate economic transactions in a time of national emergency. Trump is the first president to invoke the act in order to implement tariffs.

In his first round of tariffs imposed on Canada, China, and Mexico in February, Trump cited an effort to combat fentanyl and other illicit drug trafficking into the United States and said his rationale for the April tariffs imposed on more than 60 countries was an effort to balance the trade deficit.

There have been at least five lawsuits filed against the Trump administration in an effort to block his tariff agenda. 

Just last week, a federal judge dismissed California’s lawsuit against the Trump administration on the grounds that it lacked jurisdiction.
