The far-left federal judge who has previously interfered in the deportation of illegal alien Kilmar Abrego Garcia — a wife-beating, illegal-alien smuggler and MS-13 terror gang member — has done it again.

Appointed by former President Barack Hussein Obama, Judge Paula Xinis of the U.S. District Court in Maryland has blocked the deportation of Garcia to Uganda until he gets a credible-fear hearing.

Immigration and Customs Enforcement arrested Garcia today when he reported to authorities in Baltimore. He faces two counts of smuggling illegal aliens into the country.

The trouble for Garcia began when he was deported to El Salvador in March. The usual far-left caterwauling ensued, whereupon his criminal record, including beating his wife and membership in MS-13 surfaced. As well, in 2022, Tennessee Highway Patrol officers stopped him with a carload of illegals and suspected him of smuggling them. The Biden administration ordered him to be released.

In June, he landed back in the United States to answer allegations of human smuggling.

“Garcia and others known and unknown to the Grand Jury, conspired to bring undocumented aliens to the United States from countries such as Guatemala, El Salvador, Honduras, Ecuador, and elsewhere, ultimately passing through Mexico before crossing into Texas,” a federal grand jury’s indictment alleges.

Significantly, the jury alleges that Garcia “used his status in MS-13 to further his criminal activity.” He and his conspirators “transported thousands” of illegal aliens, “many of whom were MS-13 members and associates.”

The jury also alleges that Garcia trafficked illegal guns and narcotics.

The two-count indictment alleges violations of 8 U.S. Code 1324, bringing in and harboring illegals. One of his co-conspirators, U.S. Attorney General Pam Bondi said when he was indicted, alleged that Garcia solicited nude photos of a minor and participated in the murder of a rival gang member’s mother. If true, he’s a pervert and killer in addition to being a wife-beater and terror gang member.

After he was released from custody in Tennessee on August 22, Secretary of Homeland Security Kristi Noem announced his arrest again today. She condemned his release on the order, again, of Xinis, who apparently doesn’t think Garcia’s past is a reason to keep him locked up.

“Activist liberal judges have attempted to obstruct our law enforcement every step of the way in removing the worst of the worst criminal illegal aliens from our country,” Noem said:

Today, we reached a new low with this publicity hungry Maryland judge mandating this illegal alien who is a MS-13 gang member, human trafficker, serial domestic abuser, and child predator be allowed free.

By ordering this monster loose on America’s streets, this judge has shown a complete disregard for the safety of the American people. We will not stop fighting till this Salvadoran man faces justice and is OUT of our country.

Noem wrote today that he was being processed for removal to Uganda.

Garcia’s ever-ready attorney ran off to Xinis, who readily complied with their plea to block the deportation. After a hearing today, once again, she went to bat for the wife-beating, illegal-alien gang member.

“Your clients are absolutely forbidden at this juncture to remove Mr. Abrego Garcia from the continental United States,” the Obama appointee said, The Hill reported

“Xinis also noted that nothing in the record indicates that Uganda would not send Abrego Garcia back to El Salvador after receiving him. Costa Rica, meanwhile, offered assurance that Abrego Garcia could move freely,” the website continued::  

“The silence is taken certainly in contrast to what’s been provided by the country of Costa Rica,” Xinis said. “The contrast is significant.”

Garcia claims he fears persecution and even torture in Uganda, which might send him back to El Salvador. Xinis dutifully parroted that claim in today’s hearing.

“He also signed a document designating Costa Rica as his preferred country of removal,” said The Hill:

“Now that he has served that reasonable fear notice, he’s entitled to a reasonable fear interview,” Abrego Garcia lawyer Simon Sandoval-Moshenberg said on a press call earlier Monday. “To me, it seems very clear — crystal clear — that while we’re waiting for that interview to be scheduled, while we’re waiting for the results of that interview, they can’t put him on a plane.” 

Xinis also ordered the government not to move Abrego Garcia from the detention facility in Virginia where his lawyer said he’s being housed, to ensure he has access to counsel as the lawsuit progresses.
