

The Biden administration did more than just import and release hundreds of thousands of illegal-alien criminals into the United States.
In at least one case — and probably more — it found yet another way to keep illegal-alien rapists, murderers, and terrorists in the country: Deferral of Removal Under the Convention Against Torture, or DCAT.
Thus has Immigration and Customs Enforcement (ICE) found itself unable to deport a Salvadoran murderer and gang member.
In a separate case, federal agents bagged a Mexican child molester who nearly murdered an ICE agent. He was living in far-left Democratic Governor Tim Walz’s Minnesota. Walz thinks ICE is akin to the Gestapo, the secret police in Nazi Germany.
Fox News’ Bill Melugin reported on X that convicted murderer and Surenos gang member Alexander Alfredo Palacios Guevara was ordered deported in February 2024. Aside from one murder conviction, he has been twice convicted of attempted murder. The convictions were in Los Angeles County.
Melugin was embedded with ICE on the raid that snared Guevara. “During his ICE arrest, he repeatedly told me, on camera, that he shouldn’t be deported because he has ‘CAT,’” Melugin reported:
It turns out, his claim was true. ICE wasn’t aware during his arrest, but in the last days of the Biden admin, in December 2024, Guevara had been granted what’s known as “DCAT,” or [Deferral of] Removal under the Convention Against Torture, meaning he can’t be deported to his home country because he fears he will be tortured there.
The decision was made by the Board of Immigration Appeals (BIA), under the Biden Department of Justice, on 12/18/2024.
Now, ICE is forced to keep Guevara while it awaits permission to deport him to a third party country. Reason for the wait? A far-left “federal judge in Boston blocked third party removals earlier this year.” Thus, the matter lies with the U.S. Supreme Court.
ICE told Fox:
This criminal alien should never have been roaming the streets of Los Angeles. Not only is he a member of the ruthless Surenos gang, but he also has multiple convictions for murder, assault and rape or sexual abuse of a minor. A highly unusual Biden-era legal decision from December allowed this dangerous criminal to live in American communities. Thanks to the leadership of President Trump and Secretary Noem, we are removing public safety threats as it always should have been.
Guevara told Melugin to call his immigration attorney. He called and emailed, but she didn’t answer. “I’m free,” Guevara answered when Fox asked about his murder conviction.
Fox didn’t disclose how many other murderers — and rapists, child rapists, and gang members — received DCAT from the Biden administration.
DCAT is defined by 8 CFR 1208.17, and permits an immigration judge to defer an illegal’s “removal to the country where he or she is more likely than not to be tortured.” However, the designation “does not confer upon the alien any lawful or permanent immigration status in the United States,” and does mean the illegal will be released.
In another high-profile case, the Department of Homeland Security (DHS) collared Roberto Carlos Munoz-Guatemala, “a serial criminal illegal alien, after he dragged an Immigration and Customs Enforcement (ICE) officer 50 yards with his car in Bloomington, Minnesota, trying to evade arrest,” the agency announced:
During a traffic stop, Munoz-Guatemala refused to exit his vehicle. He tried to flee law enforcement and put his car in drive while the ICE officer still had his arm inside the vehicle, dragging the officer approximately 50 yards. This criminal illegal alien has been arrested and is in federal custody.
DHS spokesman Tricia McLaughlin said that Munoz-Guatemala’s crimes go back 15 years. They include sex crimes against an underage teenager, domestic assault, and driving without a license. ICE lodged a detainer against the sex fiend in 2013.
Said McLaughlin:
Under Governor Tim Walz, this sicko was living in Minnesota without consequence. Instead of comparing ICE law enforcement to the Gestapo, Governor Walz should be thanking our brave law enforcement for arresting these violent criminals.
Walz delivered his Gestapo smear at, of all places, the commencement of the University of Minnesota Law School on May 17.
“Donald Trump’s modern-day Gestapo is scooping folks up off the streets,” said the man known as Tampon Tim, a former National Guardsman who abandoned his troops when his unit deployed to Iraq:
They’re in unmarked vans, wearing masks, being shipped off to foreign torture dungeons, no chance to mount a defense, not even a chance to kiss a loved one goodbye, just grabbed up by masked agents, shoved into those vans, and disappeared.
Depicting ICE agents as Nazis is the latest far-left narrative. After federal agents collared more than 1,500 illegals in Boston and Massachusetts, far-left Democratic Mayor Michelle Wu likened ICE to a neo-Nazi group called NSC-131, or National Socialist Club-131.
“I don’t know of any police department that routinely wears masks,” Wu said. “We know that there are other groups that routinely wear masks. NSC-131 routinely wears masks.”
Wu has been linked to Chinese intelligence through a Chinese spy who doubled as a fundraiser for her campaign.
ICE agents wear masks for fear of being doxed, which would expose their families to attacks by Antifa and other far-left terrorists.
