Former President Trump is expected to be in the courtroom Tuesday as his attorneys attempt to persuade a three-judge appeals court panel he is immune from his federal 2020 election subversion indictment.

Special counsel Jack Smith charged Trump with four felonies for allegedly conspiring to overturn the election results, but Trump has contended he has immunity from criminal prosecution for official acts during his presidency.

The argument before the D.C. Circuit Court of Appeals is set to begin at 9:30 a.m. EST and is scheduled to last 40 minutes, though it could run longer.

Tuesday’s panel comprises circuit judges Karen Henderson, an appointee of former President George H.W. Bush; Michelle Childs, an appointee of President Biden; and Florence Pan, also a Biden appointee.
