Hunter Biden’s defense team stated in a recent court document that his plea agreement’s terms were predominantly set by Department of Justice (DOJ) prosecutors.

This deal, which was turned down by Judge Maryellen Noreika, proposed that Biden plead guilty to two minor tax violations, bypassing incarceration for a felony firearm charge.

During a July 26 hearing, Noreika raised questions about a segment of the diversion agreement that promised extensive immunity for any criminal activity mentioned in an attached statement of facts.

This statement detailed the financial compensation Biden garnered from his business ventures in China, Ukraine, and Romania.

Biden’s legal counsel communicated to the court, “As is standard in negotiated settlements, prosecutors proposed and largely shaped the structure and specifics of the Plea and Diversion Agreements. This not only pertains to how these documents were introduced to the Court but also to the exact wording of the Diversion Agreement’s paragraph 15 (the so-called immunity clause). The Defendant and his legal team engaged in honest and fair negotiations with the prosecutors throughout this process.”

Furthermore, Biden’s attorneys maintain that both parties are bound by a valid Diversion Agreement.

They emphasized that their understanding of the immunity extent being offered, which was a point of contention during the hearing, was based on the DOJ prosecutors’ “written and verbal exchanges” throughout their discussions.

They elaborated, “The Defendant’s comprehension of the immunity scope, as endorsed by the U.S., is rooted in the explicit written conditions of the Diversion Agreement and is also supported by prosecutors’ simultaneous written and verbal exchanges during plea discussions.”

However, in a motion filed on Friday, prosecutors conveyed that they foresee a trial in Hunter Biden’s case, labeling the plea deal talks as “at a deadlock.”

They commented, “The Government is now of the opinion that the case will only conclude with a trial.”

U.S. Attorney David Weiss, who has been delving into criminal accusations against Hunter Biden, was designated as the special counsel in the case this past Friday.
