In a recent New York City incident, a man named John Rote, aged 43, is facing several charges after he tried to help a woman being robbed at a subway station.

Rote was charged with criminal possession of a firearm, criminal possession of a weapon, reckless endangerment, and menacing.

His actions were prompted by a homeless man, Matthew Roesch, who accosted a woman at a Manhattan subway station late at night.

The incident occurred around 10:00 p.m. when Roesch, holding open an emergency gate, demanded money from the woman and attempted to steal her purse. In response, Rote, another commuter, stepped in and fired two shots toward Roesch to protect the woman.

City officials in New York swiftly criticized Rote’s actions, describing them as unacceptable.

NYC Transit President Richard Davey emphasized that such behavior would not be tolerated within the transit system and commended the NYPD for making a quick arrest. He stressed the importance of public safety.

NYPD Chief of Detectives Joseph Kenny provided additional details, explaining that Roesch had demanded money from the woman and continued to harass her when she refused.

Rote intervened, instructing Roesch to stop and firing a shot at his feet. After the incident, Rote reportedly threw his gun into the East River.

As a result of the incident, Roesch is now facing charges of attempted robbery and has been released with court-ordered supervision.

Tragically, the homeless man lost his life, and Penny now faces charges of second-degree manslaughter and negligent homicide.

Both cases raise questions about the role of citizens in intervening during criminal situations.
