NextImg:Federal Judge Blocks Indiana Law Protecting Children from Transgender Procedures

In a recent development, the U.S. District Court for the Southern District of Indiana has issued a preliminary injunction, partially blocking a law aimed at safeguarding children from life-altering transgender procedures.

Judge James Patrick Hanlon halted the prohibition on administering puberty blockers and cross-sex hormones to minors, following a lawsuit filed by the American Civil Liberties Union (ACLU).

The ACLU filed the suit on behalf of several parents who alleged that the law violated the constitution. However, it is important to note that the injunction does not impede the law’s prohibition on surgeries such as double mastectomies for girls identifying as boys or genital surgeries.

Indiana officials, determined to protect the well-being of minors, have vowed to defend the law. Set to take effect on July 1, the law was signed earlier this year by Republican Governor Eric Holcomb.

A spokesperson for Indiana Attorney General Todd Rokita expressed confidence in the state’s position, telling The Hill, “The Court openly acknowledges evidence showing the safety and effectiveness of puberty blockers and hormone therapy are uncertain and unsettled.”

“It also recognizes that the State has shown there are good reasons for regulating gender transition procedures for minors,” the spokesperson said.

“So, our office will continue to defend the democratically passed laws of the Indiana General Assembly, and we will continue to fight for the children,” the spokesperson continued, adding that the ruling will not be the “end of the story.”

Indiana joins a growing number of states—20 in total—that have taken steps to protect children from life-altering transgender procedures in recent years.

The ACLU promptly challenged Indiana’s law, following its signing by Governor Holcomb, as part of a larger effort to file similar lawsuits against similar laws in other states.

The ACLU of Indiana’s legal director, Ken Faulk, hailed the court’s decision to grant the preliminary injunction as a significant victory.

“Today’s victory is a testament to the trans youth of Indiana, their families, and their allies, who never gave up the fight to protect access to gender-affirming care and who will continue to defend the right of all trans people to be their authentic selves, free from discrimination,” Faulk said.

“We won’t rest until this unconstitutional law is struck down for good,” he continued.

Advocates of transgender procedures on children have adopted an aggressive legal strategy, resulting in the obstruction of state laws safeguarding minors from such procedures in several states, including Alabama, Arkansas, and Florida.

In Florida, Judge Robert Hinkle delivered a ruling against the ban on puberty blockers and cross-sex hormones, incorporating language that seemed steeped in activism.

In a 44-page ruling, Judge Hinkle made a notable statement, asserting, “The elephant in the room should be noted at the outset: gender identity is real. The record makes this clear.”

The Department of Justice under President Joe Biden has also weighed in on this matter, filing a lawsuit against the state of Tennessee for its ban on transgender procedures.

As the legal battles surrounding transgender procedures on minors continue to unfold, Indiana is determined to defend its law and protect the well-being of children.

The fight is not over.
