At a time when free speech on social media platforms is under constant scrutiny, billionaire entrepreneur Elon Musk’s firm stance as a “free speech absolutist” has once again come to the forefront and this time he is keeping his word.

Musk’s platform, known as “X,” has been entangled in a controversy involving a University of Illinois student, Juan David Campolargo, who is facing disciplinary action for his posts on the platform. Musk has not only defended Campolargo but has also reaffirmed his commitment to protecting users’ free speech rights.

Campolargo found himself in hot water after he posted an event on X, claiming it was an open gathering with free food when, in reality, it was a closed conference.

This misrepresentation led to a letter obtained by the Financial Times accusing Campolargo of violating the university’s student code of conduct, putting him at risk of conduct probation and eviction from campus housing.

Lawyers from Schaerr Jaffe, representing Campolargo “with the support of X Corp,” wrote a letter to the university, warning that if they did not reverse the preliminary finding, it would constitute a violation of his First Amendment rights.

Elon Musk, the owner of X, has been a vocal advocate for free speech on the platform. He pledged to fund legal battles and sue on behalf of X users who believe they have been treated unfairly due to their posts or interactions on the platform.

Musk’s commitment to this cause was evident when he declared, “No limit… We won’t just sue; it will be extremely loud, and we will go after the boards of directors of the companies too.”

This unwavering support for free speech comes despite Musk’s efforts to control X’s costs.

Since acquiring the platform for a staggering $44 billion just over a year ago, Musk has taken steps to loosen X’s moderation policies. While this move has been celebrated by many of his supporters and libertarian tech figures in his circle, it has also raised concerns among advertisers who fear their marketing will be associated with toxic content.

Musk’s recent agreement with an antisemitic theory online further fueled criticism, with his detractors pointing out instances where he has dismissed X employees for criticizing him.

Campolargo’s situation is emblematic of the broader debate over free speech on social media platforms. He had been running an X account, sharing information about open events on the university campus with free food.

However, a complaint led to charges against him for “inciting, aiding, or encouraging others to engage in behavior violating the Student Code” and theft for allegedly promoting and attending a private conference.

Schaerr Jaffe, in their letter, raised concerns about procedural irregularities in the university’s handling of Campolargo’s case, additional evidence that had not been considered, and the appropriateness of the imposed sanctions.

The University of Illinois, when questioned about the allegations, cited federal privacy laws and confidentiality in their student discipline process, refraining from commenting on specific cases.

Campolargo, an engineering student at the University of Illinois at Urbana-Champaign, has been known for giving TedX talks and self-publishing a book on lithium, as mentioned on his website.

In the ongoing battle between free speech and platform moderation, Musk’s commitment to protecting the rights of X users remains strong.

However, in this case the speech was not topical or opinion but, in fact, intentional misinformation on an event. It is a curious circumstance that puts in to question the valor of defense for speech for this specific incident.
