



The Fifth Circuit Court of Appeals sided with Texas by temporarily stopping the Biden administration from removing the state’s razor wire barriers along the border near Eagle Pass.

Texas, led by Governor Greg Abbott, has actively tackled the issue of illegal immigration, especially in areas with high numbers of migrants.
A major part of Texas’s strategy is the use of concertina wire at key border crossing points.

This operation also includes building a border wall and creating a barrier in the Rio Grande.
The lawsuit from Texas against the Biden administration, filed in October, claimed that the federal government was illegally damaging state property and weakening Texas’s ability to prevent illegal immigration.
Texas argued that cutting or damaging the wire allowed illegal immigrants to move further into the U.S.
The Department of Homeland Security (DHS) countered, saying that once migrants enter the U.S., Border Patrol agents must apprehend them, and the wire makes it difficult for them to do their job.
Initially, a federal court agreed with Texas and stopped agents from cutting the wire.
However, this decision was later reversed, with the judge stating that Texas hadn’t met the requirements for a more extensive injunction.
Texas appealed this decision, leading to the favorable ruling from the Fifth Circuit Court, which now stops any harm or removal of the wire while the appeal is ongoing.
The importance of this decision is underlined by the recent increase in migration in the area.
On a single day, there were over 12,600 encounters at the border, with agents in Eagle Pass processing over 4,500 people and holding 5,300 in custody.
This spike in migration shows the challenges at the border and the complexities in managing illegal immigration.
Adding to Texas’s tough stance on immigration, Governor Abbott signed a law allowing state law enforcement to arrest people suspected of illegal entry.
