NextImg:Judge Tosses Marc Elias' Suit Against WY Proof Of Citizenship Law

Russia collusion hoaxer Marc Elias was dealt a major defeat on Tuesday when a federal judge tossed his group’s lawsuit challenging Wyoming’s proof of citizenship voting law.

In his 17-page decision, U.S. District Judge Scott Skavdahl, an Obama appointee, ruled that the Equality State Policy Center lacked Article III standing to challenge HB 156. Enacted earlier this year, the statute mandates that prospective Wyoming voters provide documentary proof of citizenship and residency when registering to vote in the state.

“Under Article III of the Constitution the exercise of judicial power is confined to Cases and Controversies, which requires Plaintiff to establish a personal stake in the outcome — standing,” Skavdahl wrote. “Even accepting Plaintiff’s standing-related allegations as true and construing the record in its favor, Plaintiff has not adequately demonstrated its standing to sue on its own behalf or on behalf of others in this action. Absent Plaintiff’s showing of standing, the Court lacks subject matter jurisdiction over this lawsuit, and consequently it must be dismissed without prejudice.”

“The Court has not considered nor makes any comment on the merits of Plaintiff’s claims,” he added.

Represented by the Elias Law Group, the Equality State Policy Center filed its challenge against HB 156 not long after the law’s enactment. The group baselessly claimed that the statute “will impose new, burdensome, and entirely unnecessary requirements that will make it harder for eligible citizens to vote” and result in the “exclusion and disenfranchisement of citizens.”

The suit included additional allegations that the law would disproportionately affect female, Hispanic, young, and low-income voters, all of whom the plaintiff falsely claimed, “are less likely to have acceptable documentation and, in many cases, face greater hurdles to obtaining it.”

Wyoming Secretary of State Chuck Gray released a statement celebrating Tuesday’s decision, calling it a “huge win for the people of Wyoming.”

“Proof of citizenship for registering to vote is a common sense, conservative election integrity measure and was the number one priority of our administration’s conservative election integrity reform agenda and a key priority of President Trump,” Gray said. “Marc Elias’ outrageously wrong lawsuit has always been an attempt by the radical Left to undermine the common-sense election integrity measures Wyomingites want.”

Gray’s efforts to defend HB 156 enjoyed support from the Trump Justice Department, 25 states, and Guam, along with the Republican National Committee, according to WyoFile.
