Colorado Federal Judge Gordon Gallagher, a Biden appointee, issued an order on Wednesday blocking the Trump administration from deporting the family of radical Islamist terrorist Mohamed Soliman, who on Sunday set a dozen Jewish demonstrators on fire.

The two-page order — the latest in the string of judicial lawfare — states that the Trump administration “SHALL NOT REMOVE Hayem El Gamal and her five children from the District of Colorado or the United States unless or until this Court or the Court of Appeals for the Tenth Circuit vacates this Order.”

The order comes hours after Department of Homeland Security Secretary Kristi Noem announced that DHS and Immigration and Customs Enforcement (ICE) “have taken the family of suspected Boulder, Colorado terrorist, and illegal alien, Mohamed Soliman, into ICE custody.”

ICE detained Soliman’s wife, Hayam Salah Alsaid Ahmed Elgamal, and his five children and processed them for removal, according to the Department of Homeland Security. All are citizens of Egypt. While Soliman is an illegal alien, the legal status of his family members is unclear.

Soliman set Jewish demonstrators on fire in Boulder, Colorado, on Sunday, injuring a dozen, including a Holocaust survivor. The demonstrators were calling for the release of the hostages being held by Hamas.

As I previously wrote in these pages, “Deporting the family of a radical Islamist terrorists is not only justified — it’s necessary. A sovereign nation has the right and obligation to remove individuals who may present a danger to Americans and the American way of life.”

But this isn’t the first time an unelected judge has usurped the authority of the executive branch. Just recently a district court judge ordered the Trump administration to continue to allow thousands of immigrants to remain under a parole program misused by the Biden administration, permitting the aliens to work in the country.

Another unelected district court judge, Allison Burroughs, halted the administration from making “any permanent changes to Harvard’s student visa program.”

The Federalist’s Mollie Hemingway recently pressed the White House, asking if it has plans to take action to stop the judicial coup taking place.

“The second Trump administration … seems to be subject to an effort to stymie the agenda using rogue lower court judges,” Hemingway said. “It also seems there’s not much of an actual coordinated effort from this White House to take and tackle this effort from judges, Democrats, and other people using these judges to stymie the agenda. Is there an actual effort by this White House to tackle this issue in a comprehensive way, and if so, what is it?”

Leavitt said that there “is an effort by this administration to tackle these rogue judges and the injunctions and the blockades that we have faced in our broken judicial system,” but did not specify what that effort is.
