


President Donald Trump chalked up another victory in the United States Supreme Court after it ruled that the administration could freeze $783 million in Diversity, Equity, and Inclusion (DEI) gender identity and race-based grants for research with the National Institutes of Health.
In a 5-4 ruling on Thursday, SCOTUS denied the motion for a stay in NATIONAL INSTITUTES OF HEALTH, ET AL. v. AMERICAN PUBLIC HEALTH ASSOCIATION, ET AL. by siding with the administration, allowing for the termination of hundreds of millions of dollars in grants to the NIH, which were started during Dr. Anthony Fauci's leadership.

In Thursday's ruling, the Supreme Court lifted a district court's ruling that had attempted to block the administration's removal of the millions of dollars in grant money.
It read:
The Administrative Procedure Act's "limited waiver of [sovereign] immunity" does not provide the District Court with jurisdiction to adjudicate claims "based on" the research-related grants or to order relief designed to enforce any "' obligation to pay money'" pursuant to those grants.
It went on:
Moreover, the plaintiffs' contention that they lack the resources to continue their research projects without federal funding is inconsistent with the proposition that they have the resources to make the Government whole for money already spent. The application is otherwise denied.
Chief Justice Roberts joined the liberals in dissent with Justice Sonia Sotomayor, Justice Elena Kagan, and Justice Ketanji Brown Jackson.
Justice Amy Coney Barrett joined the majority along with Justice Brett Kavanaugh, Justice Clarence Thomas, Justice Samuel Alito, and Justice Neil Gorsuch.
The concurring decision from Barrett read that "NIH issued internal guidance documents describing those priorities: Going forward, the agency will not fund research related to DEI objectives, gender identity, or COVID–19. Nor will it continue the practice of awarding grants to researchers based on race."

The Trump administration notched another appellate win on Tuesday, with a 4th Circuit Court of Appeals ruling vacating a lower court injunction blocking DOGE IT access to the Department of Education, Office of Personnel Management, and Department of the Treasury, in the case styled American Federation of Teachers v. Bessent.
The administration also scored a win in the D.C. Circuit Court of Appeals, with the appellate court denying the plaintiffs' motion for a stay pending appeal in Coalition for Humane Immigrant Rights v. DHS (challenging an interim final rule re: immigration registration).
