Day 2 of the 2025 term for the Supreme Court features oral argument in two more cases:
- Chiles v. Salazar — Whether a law that censors certain conversations between counselors and their clients based on the viewpoints expressed regulates conduct or violates the Free Speech Clause.
- Barrett v. United States — Whether the Double Jeopardy Clause permits two sentences for an act that violates 18 U.S.C. § 924(c) and§ 924(j), a question that divides seven circuits
but about which the Solicitor General and Petitioner agree.
The court also handed out a lengthy order list, granting certiorari (or other relief) in some cases, but denying it in others, including as to Ghislaine Maxwell's appeal.

We're still waiting to see what comes of Gaza peace talks and the Schumer Shutdown.
On the court front, we'll be keeping a close eye on what the 9th Circuit does in the Oregon National Guard case.
There are some things it's just impossible to fathom. Hamas' attack on Israel on October 7, 2023, is one of those things. I will never understand the sheer barbarity of that day — and I don't want to.
The fact that it's been two years since that awful day — and there are still hostages being held — is one of those things. I know there's a glimmer of hope that they will soon be returned. I hold onto that hope. But they should have been home long ago. They should never have been taken.
That, following the horrific attacks, we saw a rise in antisemitism is one of those things. The level of animosity directed at Jewish people, the attacks even here in the U.S., the calls for global intifada, the effort to blame any and all things on Israel and the Jews — miss me with that.
It feels overly simplistic to just attribute it all to evil — or sin. But I don't know how else to describe it. What I do know is that it needs to end. The hostages need to come home, and Hamas needs to be rendered powerless. Yesterday.
