


New York Attorney General Letitia James has a new strategy to combat credible allegations that she committed mortgage fraud. Appearing with racist lunatic and former MSNBC host Joy Reid, James explained that the Department of Justice should back off because their pursuit of her is "baseless."
Is it baseless because she didn't do it? That's the wild part. James essentially admits she did the deed, but then settles on claiming the DOJ can't prove she meant to do it, so it's fine.

JAMES: Donald Trump said that he wanted, he said that I was, he called me all kind of names, and he basically directed the DOJ to investigate my affairs. And they're using mortgage fraud as the vehicle upon which they are investigating myself, Adam Schiff, Mrs. Cook, Lisa Cook, and countless others, and it is, most of it, as you know, is frivolous, it's baseless because in order to prove mortgage fraud, one has to prove intent, and that's a very hight standard, high bar to meet.
Well, at least the DOJ now knows what her defense will be if they ever get around to pressing charges (that's another complaint for another day). It's not that she's technically wrong, but openly taunting prosecutors by excusing her alleged criminality on the basis of saying "whoops" is a choice, I guess. Yes, intent will need to be proven, but James is misleading when she suggests that what she did was obviously an accident and that there's no evidence of intent.
It belabors belief that she had no idea what she was doing when she listed her father as her husband on a mortgage. That's not an accident people make. I've never been tempted to list a parent as my spouse on any of my mortgage documents because that would be ridiculous.
Further, when it comes to proving intent, patterns of illegality help testify to it. James went on to misrepresent a New York City rental property as being four bedrooms instead of its actual five. That cut-off just so happened to secure her a much lower interest rate. Then in 2023, she claimed a house in Virginia as a primary residence, again securing a lower interest rate in the process.
So either James is the most careless, stupid attorney general in American history, or she was doing what it looks like she was doing, which is gaming the system multiple times to secure lower interest rates and save money. And while stupidity can be a defense, the idea that it's impossible to prove intent is silly. By that logic, every single person who has ever committed fraud could simply say "oops" and never be convicted. But we know people do get convicted of fraud, and it doesn't require a written confession to prove intent. The DOJ seemingly will have ample material to work with to show James knew what she was doing.
James needs to be held accountable. She has weaponized the law against her political opponents in grotesque ways and now believes she is above it. That's a dangerous standard to let lie. The DOJ needs to make hay here.
