NextImg:Judge Puts the Kibosh on Kilmar Abrego Garcia's Bid to Reopen His Immigration Case

The saga of Kilmar Abrego Garcia—the reputed MS-13 gangbanger, illegal alien, and alleged human smuggler who the mainstream media dubbed the “Maryland father"—continues. He was first mistakenly deported to El Salvador's CECOT mega-prison in March, then returned to the U.S. following a series of court rulings, but was quickly charged with human smuggling.

Although the government threatened to deport him to Uganda, he currently resides at an ICE facility in Phillipsburg, Pennsylvania.

On Wednesday, an immigration court refused to reopen his case:

His lawyers tried to fight his removal from the U.S. but one thing is certain, this Salvadoran man is not going to be able to remain in our country. He will never be allowed to prey on innocent Americans again.

NBC News Puff Piece on Abrego Garcia Facing Deportation to Uganda Is Something Else

The judge ruled that Abrego’s filing was “untimely”:

In the emergency motion filed in August to reopen the case, attorneys for the wrongly deported Abrego Garcia argued that because he was deported to El Salvador and then brought back to the United States, he is now eligible to apply for asylum within one year of his last entry into the U.S.

But in the order filed on Wednesday, Regional Deputy Chief Immigration Judge Philip Taylor said that Abrego Garcia's motion to reopen his motion to seek asylum is "untimely" because he filed the motion nearly six years after his immigration proceedings -- beyond the 90-day deadline required. 

The judge also ruled that although the government had floated the idea of deporting Abrego Garcia to Uganda, it was not necessarily a done deal:

“The word ‘may’ is permissive,” Regional Deputy Chief Immigration Judge Philip Taylor wrote in his opinion.

“[It] indicates to the Court that in sending this notification to Respondent’s counsel, the Department sought to convey that it reserved the right to remove him to Uganda, not necessarily that it intended to do so, that it had decided to do so, or that it would do so imminently.”

Democrats and Republicans have vastly different views of the case, with senators like Chris “Margarita” Van Hollen (D-MD) flying down to El Salvador in April to cozy up to the “Maryland father,” while President Trump said the lawmaker “looked like a fool” and was a grandstander.

Abrego Garcia has 30 days to appeal, and until then, he cannot be deported. What’s next in this long-running story is anybody’s guess.
