NextImg:Judge Makes Wildly Insane Ruling on Trump Revoking TPS - May Have Topped Planned Parenthood Absurdity

I'll be honest. When I saw the latest ruling from Boston-based Federal Judge Indira Talwani regarding Planned Parenthood funding, I wasn't sure things could get more absurd. Her decision was so divorced from any legally supported justification that it seemed to be the peak.

I'm sorry to say that I may have underestimated the determination of the federal judiciary because on Thursday, this abject insanity dropped.

It's important to note the context of the people involved here. Specifically regarding the Central Americans granted temporary protective status, that happened under the Clinton administration in response to Hurricane Mitch. Since 1998, that status has been used as a de facto amnesty despite the countries in question having fully recovered some two decades ago. As for those from Nepal, their status stems from an earthquake that struck in 2015. 

So, before we even get into the details, the justification to continue TPS for the populations in question seems stretched beyond absurdity. Does the word "temporary" even mean anything at this point? It sure doesn't seem like it if a judge can decree it permanent despite the justification for the status no longer even existing. 

But it's the reasoning behind this order that is truly mind-blowing. According to Judge Trina L. Thompson, she can override the administration by deeming the decision was made based on "racial animus" and an adherence to "replacement theory." Likewise, she claimed that the Trump administration was removing TPS to force people to "atone for their race, leave because of their names, and purify their blood" and compared it to the transatlantic slave trade.

“The freedom to live fearlessly, the opportunity of liberty, and the American dream. That is all Plaintiffs seek. Instead, they are told to atone for their race, leave because of their names, and purify their blood,” Thompson said.

Lawyers for the National TPS Alliance argued that Noem’s decisions were predetermined by President Donald Trump’s campaign promises and motivated by racial animus. 

Thompson agreed, saying that statements Noem and Trump have made perpetuated the “discriminatory belief that certain immigrant populations will replace the white population.” “Color is neither a poison nor a crime,” she wrote.

I'm at a loss for words reading that. How do you even describe how insane that is, coming from a judge who has no proof at all to back up any of her statements of motive? This decision might as well have been written by The Daily Beast or Mother Jones, except even those far-left outlets would probably couch their words a little better. 

Thompson also accused the Trump administration of not taking an "objective" look at the conditions in Nicaragua, Honduras, and Nepal before rejecting TPS despite Secretary of Homeland Security Kristi Noem citing data showing all the countries in question had made significant progress since being hit by natural disasters. The judge cited "political violence" and "recent hurricanes" as justification to override the administration. 

U.S. District Judge Trina L. Thompson in San Francisco did not set an expiration date but rather ruled to keep the protections in place while the case proceeds. The next hearing is Nov. 18.

In a sharply written order, Thompson said the administration ended the migrant status protections without an “objective review of the country conditions” such as political violence in Honduras and the impact of recent hurricanes and storms in Nicaragua.

TPS was not granted for either of those things, so how can a judge decide to extend it for them? And given that TPS is the sole authority of the president to grant, how can it not be the administration's sole authority to revoke it? Using the phrase "judicial activism" may actually be too tame in this case. 

It's been said before, and it'll be said again, but none of this stops until Chief Justice John Roberts grows a backbone. These left-wing district court judges are destroying the judiciary, and limited rulings by the Supreme Court, nibbling at the edges, aren't going to be enough to stop them.
