


With the recent resolution of the Lia Thomas affair, in which the male swimmer cosplaying as a woman to gain an unfair advantage had his unearned honors stripped away, we harbor some hope that this lunacy has finally run its course. Now the nation's highest court is involved: The Supreme Court will now hear several cases involving "transgender" students in girls' and women's sports. Two of the cases come from Idaho and West Virginia.
The Supreme Court on Thursday waded into the legal fight over state laws that ban transgender athletes from competing in girls' and women’s school and college sports, taking up cases from West Virginia and Idaho.
The court will hear cases involving two transgender students, Becky Pepper-Jackson and Lindsay Hecox, who challenged state bans in West Virginia and Idaho, respectively.
Both won injunctions that allow them to continue to compete in sports. Pepper-Jackson, now 15, takes puberty blocking medication, while Hecox, a 24-year-old college student, has received testosterone suppression and estrogen treatments.
Note the careless wording here. Both are males claiming to be "transgender" and both are demanding to compete against actual girls and young women; we have covered time and again, the unfair advantage even a boy or young man on hormone treatments has over female competitors. This story states that both "...won injunctions that allow them to continue to compete in sports."
They were, of course, always free to compete in sports. At issue is whether they should be allowed to compete, unfairly, against actual female athletes.

The American Civil Liberties Union (ACLU) is, of course, already involved.
"Categorically excluding kids from school sports just because they are transgender will only make our schools less safe and more hurtful places for all youth," said Joshua Block, a lawyer with the American Civil Liberties Union, who is part of the legal team representing both students. "We believe the lower courts were right to block these discriminatory laws, and we will continue to defend the freedom of all kids to play.”
This is a false and pernicious statement. The "less safe" statement is pure nonsense; it's just a shibboleth the left loves to trot out whenever they disagree with something. In this case, though, there is a point to be made; the status quo is what makes girls and young women less safe, as in recent months we have seen several injuries, some severe, inflicted on girls and young women by male athletes. And, again, the "kids" have always and will always have the freedom to play — on the appropriate teams.
We're turning a corner on this issue, and we can hope the Supreme Court will stomp the brakes on this lunacy once and for all.

While the legal issues will be debated and decided in the appropriate forum now, at heart this is a matter of biology - and, yes, of fairness. The two "transgender" students in the cases described above, Becky Pepper-Jackson and Lindsay Hecox, are not girls. They are, respectively, a boy and a young man. Hormone treatments do not negate the advantages they have from conception: Higher cardiovascular capacity, more robust skeletal structure, more muscle mass, more fast-twitch muscle fibers; in short, more strength and endurance.
These are facts.
What's encouraging about the Supreme Court taking this cases is this: At this level, any decision must be based at least in part on biology; even if one "transgender" boy is so far down the fitness scale, several standard deviations away from the norm, a decision by the nation's top court must not be decided on the basis of one person. No, the Court should decide this as a matter of policy for all schools, for all sports, and for all athletes, and the only fair and scientifically valid way to do that is to uphold the bans on "transgender" students - males - playing on girls' and women's sports teams.
