NextImg:Back to SCOTUS: Trump Admin Seeks Stay in Another Education Department Case

The Trump administration is back at the Supreme Court, this time with an application to stay yet another ruling from Massachusetts District Court Judge Myong Joun blocking the administration's efforts to restructure (and ultimately dismantle) the Department of Education (ED).

The Trump administration is asking the Supreme Court to block a lower court ruling that is keeping it from restructuring the Department of Education. 

"That injunction effectively appoints the district court to a Cabinet role and bars the Executive Branch from terminating anyone, even though respondents conceded that some other [reductions in force] would plainly be proper," the SCOTUS filing reads.

On Wednesday, a federal appeals court declined to lift a judge’s order blocking President Donald Trump from carrying out his executive order that would shut down the department, according to Reuters. In the executive order, which was issued in March, Trump asserted that "closing the Department of Education would provide children and their families the opportunity to escape a system that is failing them."

To give a little more context here, in May, Judge Joun granted a preliminary injunction blocking the administration from carrying out a significant reduction in force at the ED pursuant to Executive Order 14242, signed by President Donald Trump in March.

The administration appealed Joun's ruling to the 1st Circuit Court of Appeals and sought a stay of the ruling pending appeal in both the district court and the court of appeals. Both lower courts declined to enter a stay, so now the administration is seeking one from the Supreme Court. 

Of note, in April, SCOTUS granted the administration's application in another case involving the ED and the very same district court judge (regarding the termination of various education-related grants).

The administration subsequently dismissed its appeal in that case, and the litigation is proceeding in the district court. However, Judge Joun recently recused himself in that case for unspecified reasons.
