Harvard Law School Professor Emeritus Alan Dershowitz, whom I’ve argued should just give up on his Democrat roots and come over to the party of reason, thinks that Kilmar Abrego Garcia and his backers made a poor choice to push for his return to the U.S. to face criminal charges for smuggling illegal immigrants. As we’ve reported, the alleged MS-13 gangbanger was mistakenly deported to El Salvador in March and quickly became the left’s newest hero.
Dershowitz appeared on “The Record with Greta Van Susteren” Friday and said that Abrego Garcia and all his Democrat supporters may rue the day they lobbied so hard for this:
“I think it was a big mistake for him and his supporters to try to bring him back to the country,” Dershowitz said. “He’ll regret that. He’d have been a lot better off if he had made the following motion, if he had said ‘Look I’m deportable, and I don’t want to come back into the country.'”
Watch:
The United States is definitely one place he should not want to go:
Dershowitz added that Garcia’s best chance for freedom would have been to accept deportation to a safer country. He specifically mentioned Argentina as a potential destination that could have avoided the risks associated with returning to the U.S.

Dershowitz continued, saying Abrego Garcia might have had a shot at freedom but now he’s potentially facing years staring at concrete walls:
“‘Just don’t send me to a country that poses danger. Send me to Argentina.’ He might have won that case, and he would be a free man. Now he’s going to, if he’s convicted, spend a lot of time in prison, and he’s going to wish he had been deported,” Dershowitz said.
THIS IS THE DEMOCRATS' HERO.
Bondi says Garcia will eventually be returned back to El Salvador after he completes his sentence in an American prison.
Meanwhile, the famed lawyer said, Abrego Garcia’s backers—like Maryland Sen. Chris Van Hollen (D) actually did him no favors and cared more about their own soundbites than they did about him:
Dershowitz said Garcia’s supporters might not have served his best interests by encouraging him to come back to the country…
“When backers support people, they don’t always serve the best interest of people. Because they have a narrative. They have an ideology that they’re serving. The best interests of this man probably would have been served by not coming back to the country,” Dershowitz said.
As RedState’s Nick Arama reported in May, Abrego Garcia is no hero:
…Abrego-Garcia was pulled over in the state on suspicion of human trafficking in 2022. Highway patrol officers found eight other people in the car, which was registered to a convicted human smuggler. They also found $1400 in cash, which was suspected to be payment for the run. The then-Biden-led ICE never showed up to detain Abrego-Garcia on what would have presumably been federal charges, and he was released.
Now, the convicted human smuggler has not only been revealed, but he's cooperating with the Trump administration's Department of Justice. As part of a "limited immunity" deal, Jose Ramon Hernandez Reyes has confirmed that he did hire Abrego-Garcia to traffic illegal immigrants.
The Democrats don’t actually care what happens to the guy; that was all performance theater because they thought they could use the issue to “get Trump.” They’re likely to end up with serious egg on their faces, and Abrego Garcia will, as Dershowitz opines, deeply regret coming back to the US of A.
Thanks to President Trump, illegal immigration into our great country has virtually stopped. Despite the radical left's lies, new legislation wasn't needed to secure our border, just a new president.
