A grand jury has rejected a request by federal prosecutors to indict the former Justice Department employee who assaulted a federal law enforcement officer with a sandwich. 

Earlier this month, Sean Charles Dunn was fired from the Department of Justice (DOJ) after chucking a Subway sandwich at a U.S. Customs and Border Protection agent. Dunn himself worked in the DOJ criminal division’s international affairs section.

Prosecutors sought to charge him with felony assault on a federal officer. However, the grand jury in D.C. voted against returning an indictment.

Grand jurors typically decide in secret proceedings whether sufficient evidence exists for an indictment, and prosecutors could still attempt another case against Dunn.

Videos shared on social media show an agitated man in a pink polo shirt and light shorts speaking to a small group of agents on a sidewalk, while holding a wrapped Subway sandwich in one hand. 

The man, later identified as Dunn, then hurled the sandwich at the chest of an officer before running away, with at least three officers chasing him.

“I just learned that this defendant worked at the Department of Justice — NO LONGER,” Bondi said in an X post at the time.

“This is an example of the Deep State we have been up against for seven months as we work to refocus the DOJ,” she added. “You will NOT work in this administration while disrespecting our government and law enforcement.”
