


A Virginia school dismissed concerns from its female students about a male peer with facial hair being allowed in their locker room — even after accusations that the boy would just stand there and watch them, according to a civil rights complaint.
Fairfax County Public Schools is facing a possible Title IX violation after freshman girls’ pleas for help instead led to them being rushed to change for gym class to accommodate the male student, according to documents.
The issue exploded on Sept. 2, when a 14-year-old girl saw a male sophomore with facial hair inside her locker room ahead of PE class at West Springfield High School, the complaint alleges.
The teen boy — whom school administrators said identifies as a female — was allegedly watching the girls get changed, the complaint states.
The complaint also claims that while the boy identifies as female, he’s also used the boys’ locker room and bathroom at the high school.
The rattled girl and her mother started reaching out to different staff over the next two weeks, including administrators, but did not get much help, according to the complaint crafted by the conservative organization Defense of Freedom Institute.
Other girls and their parents also reportedly called the school about their concerns as the student kept using the girls’ locker room.
“I’m just dumbfounded that this is even a thing, that I’m having to go to this length in order to protect my child,” the mom told the National Review.
While assistant principals allegedly told the 14-year-old’s mother that a staff member instructed the boy not to enter the locker room during a review of the matter, they explained they wouldn’t stop him or punish him if they kept doing it.
The school leaders also allegedly suggested that the girls who were worried about changing in front of their classmates could use single-occupancy unisex bathrooms.
But on Sept. 22, school staff instead “cut short” the amount of time the freshman girls can spend in the locker room to allow “the boy to use the locker room after them without being in their presence,” the complaint states.

The boy would then be able to enter the locker room to change with other female students in his grade.
“After this episode, WSHS administrators called [the girl’s mother] to inform her that the boy has a right to use the girls’ locker room because he identifies as female,” the complaint alleges.
Fairfax did not immediately return a request for comment on Wednesday afternoon.
The district is among a string of liberal schools that could lose millions in federal funding based on their transgender bathroom policies, officials told The Post this week.
“Despite recent actions by the Education Department, Fairfax County continues to allow boys to use girls’ bathrooms, locker rooms, and other intimate facilities as a condition of its educational program,” said DFI president and cofounder Bob Eitel.
“Given its repeated violations of Title IX and refusal to cooperate and comply, FCPS should lose its federal funding until it complies with Title IX.”
Fairfax Schools chief Michelle Reid said earlier this month the district is “committed to providing a safe, supportive, and inclusive school environment for all students and staff members, including our transgender and gender-expansive community.”
