Suspended undercover cop Erik Duran will be cleared of any wrongdoing “once a full and complete investigation is conducted,” his lawyer declared.
Scooter-riding suspect Eric Duprey, 30, died when the undercover NYPD sergeant hurled a cooler at him, authorities said.
A grand jury is expected to weigh charges against Duran, according to a source.
But Duran’s attorney, Andrew Quinn, said the case is anything but open and shut.
“There is much more to this situation than the brief, 10 second video clip shows,” Quinn told The Post.
“What is indisputably clear is that the deceased, who was intent on evading arrest for selling drugs to an undercover officer, was speeding on a motorbike in an incredibly dangerous manner down a crowded sidewalk, jeopardizing the life and safety of everyone there.”
“Once a full and complete investigation is conducted, we are fully confident that Sgt. Duran will be exonerated of any misconduct or wrongdoing.”
Duran allegedly chucked what’s believed to be a plastic cooler at the fleeing man — causing him to lose control of his motorized scooter, strike a parked car and fall to the ground, sources said.
Duprey died from “blunt force injuries of the head,” according to the city medical examiner confirmed, which deemed the death a homicide.
The now-suspended Duran, was conducting a buy-and-bust operation on Aqueduct Avenue near West 190th Street in Kingsbridge Heights around 5:30 p.m. Wednesday when the suspect took off, authorities said.
Police said Duprey made a break for it after he sold drugs to the undercover officer.
Duprey had at least two previous arrests, including an open felony assault case in the Bronx from June 2022 for allegedly throwing a two-litre bottle of soda through someone’s driver-side window, sources said.
The NYPD’s Force Investigation Division and State Attorney General’s Office are investigating the actions of Duran, a 13-year veteran of the force.
