


The mentally ill Bronx man accused of randomly bashing a female cop over the head with a bottle was ordered back to Rikers Island on Friday — as kin said the system failed him and he really should be in a hospital.
At a Bronx court hearing, Judge Linda Poust-Lopez ordered suspect Jose Garcia, 45, be held on the same bail conditions that were set after his arrest in the caught-on-camera assault in the Kingsbridge section of the borough Monday.
His lawyer, Matthew Wasserman, had asked for “voluntary or involuntary hospitalization” for Garcia, adding, “My client has not seen a psychiatrist and has not received medication at Rikers.”
The judge did order a psychiatric evaluation for Garcia, whose family was in court and later told The Post he is a bipolar schizophrenic who keeps getting in and out of mental wards.
“He is a gentle person, and unfortunately we tried to get him all the help we could,” said Garcia’s nephew, who declined to give his name.
“We contact the hospital, and we say he’s a threat, he’s a threat to himself, he’s a threat to his family members, and unfortunately, in less than 24 hours, he’s home.
“The system is definitely not doing enough to help,” the nephew said. “He needs to be in an institution.”
Garcia, who has 11 prior arrests, was busted this week for allegedly attacking the cop outside of a smoke shop on 231st Street and Broadway.
After the attack, the disturbed man ranted that God “told him to do this,” sources told The Post.
Garcia was hit with assault, obstruction of government administration, resisting arrest, menacing, criminal possession of a weapon and harassment for the attack.
“If you notice, the crime rate has gone up, and that’s all because of mental health,” a woman with the family claimed.
“And the city is not doing anything. They send in cops for nonsense instead of having a system in place for helping these people.”
Garcia is due back in court May 9.
