Israel’s Supreme Court Monday overturned Prime Minister Benjamin Netanyahu’s controversial law that limited judicial powers in a decision that threatens to throw the country back into civil division as the war with Hamas continues.

The high court narrowly struck down the law passed in July that prevents judges from annulling government decisions they find “unreasonable.”

The Middle Eastern county saw months of mass protests leading up to the passage of the highly contentious legislation — passed with 64 votes in the 120-member Knesset and which was part of a package of planned reforms for the judicial system.

But the overhaul was paused after Hamas militants caught Israel off guard when it attacked the Jewish state on Oct. 7 killing 1,200 people and kidnapping 240 more.

In Monday’s 8-7 majority ruling, the Supreme Court said it canceled the law over “severe and unprecedented harm to the core character of the State of Israel as a democratic country.”

The court also found the Knesset isn’t “omnipotent” and held that the justices have the power to strike down “Basic Laws” — or major parts of the law which are akin to a constitution in the country.

Opponents argued the overhaul would move Israel away from Western democratic norms by diminishing checks and balances between the branches of government. They feared this would lead to corruption and nepotism in important government posts.

Netanyahu and his allies argued that the changes would limit the power of unelected judges and would instead place more authority in the hands of elected officials — strengthening democracy.

The challengers of the overhaul viewed it as a way for Netanyahu to shore up power and limit the power of the courts — as he stands trial on corruption charges.

The country’s divisions were mostly sidelined because of the war but Monday’s ruling could renew civil unrest.

The decision came as President Esther Hayut served her last day in office Monday ahead of her retirement.
