Manhattan prosecutors may pursue a new indictment against Harvey Weinstein in the wake of new sexual harassment claims — just as the disgraced movie mogul is scheduled to be retried on rape charges later this year.

At a Wednesday court hearing, Assistant District Attorney Nicole Blumberg said prosecutors are parsing through which of the new claims fall under the statute of limitations — before adding that some potential survivors who were too timid to testify during Weinstein’s first trial might be willing to step forward for his second.

Judge Curtis Farber also offered a firm reminder to the attorneys involved that they should “refrain from pandering to press,” and that the case will be decided in the courtroom — not “the court of public opinion.”

Farber’s comments came in response to a letter from prosecutors asking the court to “remind defense counsel of their ethical obligations regarding out-of-court statements during a public case” after Weinstein attorney Arthur Aidala allegedly made statements that might have intimidated a witness.
