


Former MTV star Bam Margera will remain in jail following his recent DUI arrest to undergo an addiction evaluation, his lawyer says.
TMZ reports Margera has been ordered to undergo a drug and alcohol evaluation Tuesday, Sept. 24, before his scheduled follow-up hearing Wednesday.
Margera’s lawyer Michael T. Van Der Veen told the outlet, “Bam has been doing very well and for the past year or more has passed all his drug and alcohol screenings. His professional life has been going well and we look forward to his release so he can continue his growth.”
The former Jackass star was arrested Sept. 16 in Fulton County, Pennsylvania, for driving under the influence and reckless driving, violating the probation he was placed under after allegedly assaulting his brother in 2023.
The Chester County judge said he is holding Margera for evaluation because he had a previous DUI arrest from 2018. Per 6ABC, the judge was “unwilling to release Margera and give him any opportunity to get behind a wheel and potentially kill somebody.”
Margera’s attorneys claimed he’s “passed every drug and alcohol evaluation” since he was placed on probation. Van Der Veen added that Margera is also willing to take the steps necessary in his recovery.

“Everybody in the courtroom is interested in his help, but he is too. He’s interested in getting better. He’s interested in getting this case behind him and we’re going to make sure that happens,” Van Der Veen said.
This is Margera’s latest run-in with the law since being placed on six months of probation in June 2024 connected to the 2023 assault against his brother.
At the time, his brother, Jess Margera, claimed Bam “banged on and kicked his locked bedroom door, [wrote] a threatening note, urinated in the kitchen sink, screamed at him, and struck him in the head.” He also claimed Bam threatened to kill “everyone in the house” and threatened to “put a bullet” in the heads of their parents, April and Phil Margera.
The incident occurred just weeks after Bam was arrested for public intoxication at a Los Angeles restaurant and nearly two years after he was booted off of Jackass Forever for failing to comply with the wellness clause in his contract that required he not use drugs during production.
After pleading guilty to the DUI charges, Margera told the court, “With the path I was on with alcohol and drugs, I needed to hit some rock bottom to turn things around. Now, I am on the right path.”
According to TMZ, Margera is expected to be released Tuesday or Wednesday at the latest.
