Prime Minister Justin Trudeau’s decision to prorogue Parliament after announcing his pending resignation was opposed by many Canadians. But they should be even more opposed to a recent Federal Court decision to expedite a legal challenge that could, if successful, overturn it.

On Jan. 8, David MacKinnon and Aris Lavranos asked the court to negate Governor-General Mary Simon’s decision to accept Trudeau’s advice and prorogue Parliament until March 24. The plaintiffs also asked the court to expedite the process, arguing that prorogation prevents Parliament from properly combating U.S. President Donald Trump’s threat of imposing 25 per cent tariffs on all Canadian products.
