Courts quite properly hold that there is no place for stereotypes in sexual assault trials. It is recognized that many stereotypes used by courts in the past were based on sexism, racism or other conscious or unconscious biases, and this had made trials unfair. However, with the recent decision in the twin case of R. v. Kruk and R. v. Tsang, the Supreme Court has found a role for stereotypes again: to convict people accused of sexual assault.
