Lost somewhat amid the aftermath of Ontario’s Feb. 27 election was the Supreme Court of Canada’s March 7 decision declaring unconstitutional the third-party fundraising rules under which that election, and indeed the one before it, were held. Whoops!

In a five-to-four decision featuring two separate dissents, the court ruled that the $600,000 limit on third-party spending in the 12 months leading up to an election “create(s) an absolute disproportionality in the broader political discourse” that favours political parties over third-party actors.
