Biden, the Ninth Circuit upheld a lower court order vacating the government’s rule that applies a presumption of asylum ineligibility for any noncitizen who traveled through another country other than their own before entering the US. Dissenting, Judge Lawrence VanDyke would deny the stay “because the government has not provided a sufficient reason to grant it.”
