The Republican National Committee lost a Pennsylvania election case ruling at the United States Supreme Court Friday evening. The after-hours order from the nation’s highest court in Republican National Committee v. Faith Genser concerns whether Keystone State voters who submit a deficient mail-in ballot may then cast a provisional ballot by right. A recent Pennsylvania Supreme Court order mandated the counting of such provisional ballots, and the RNC asked the US Supreme Court to order the practice to stop – or, in lieu of banning it, to segregate those ballots for later determination.

Justice Samuel Alito handled the appeal because he is assigned to emergency appeals from that judicial circuit. He didn’t rule on it by himself but referred it to the full court, as is often done in highly controversial cases. It is noteworthy that Justices Clarence Thomas and Neil Gorsuch added their name to Alito’s statement accompanying his order denying the RNC petition. These orders are not like judicial opinions in cases heard at oral arguments. In those cases, all justices record their vote. These two made it a point to stand with Alito here.
