NextImg:‘She expects to be punished!' Lawyer pleads for mercy as British backpacker faces 20 years in jail over drunken e-scooter death

The lawyer representing a British backpacker facing 20 years behind bars in Australia has described the "terrifying" ordeal, as she awaits sentencing in a high-security remand prison.

Alicia Kemp, a 25-year-old graduate from Worcestershire, pleaded guilty to causing the death of a father-of-two in Perth, following a drunken e-scooter crash.

The Briton collided into the back of Thanh Phan, who died of fatal head injuries, whilst being three times over the legal limit, following a reported six-hour pub session.

Speaking exclusively to GB News, her defence lawyer Michael Tudori told Britain’s Newsroom: "It was a tragedy all around.

"This poor girl was out celebrating with her friends and unfortunately got very drunk.

"She wasn’t travelling at great speed, with these scooters capped at 20 km/h. It was a sliding doors moment."

Tudori described the fatal encounter as "pedestrian versus scooter" and clarified that she was observing local laws by driving the vehicle on the pavement.

He explained: "There is a distinction between getting into a car, starting it, and killing someone. The scooter was going 20 km/h - not particularly fast."

Discussing the moment that Kemp collided with the pedestrian, Tudori said "it wasn’t a particularly large thud - and there are some other provocations which will come out in due course".

On Monday, Kemp appeared at Perth Magistrates' Court via video link from prison to enter her plea. She admitted to a charge of dangerous driving causing death under the influence of alcohol.

An additional charge of causing harm to a passenger while under the influence of alcohol was dropped.

Her friend, who was on the back of the e-scooter during the incident, suffered a fractured skull and broken nose.

"Alicia is not asking to be let off," the lawyer told GB News.

"She understands what she did is very serious, she is very remorseful, and she expects to be punished."

"I won’t estimate the sentence she will be given, but we expect it to be specifically lower than the maximum 20 years.

"This is a young girl who has never been in trouble with the police before."

Speaking of her present situation, Tudori described a fearful life as the young graduate awaits her punishment.

"It is still to be determined if her family will come over from Redditch. Alicia is being held in a high-security remand prison, as bail is not regularly granted for foreigners arrested in Australia.

"Unfortunately for her, there are not many female prisons in Western Australia, so Alicia is in a high-security facility for now, before she will eventually be moved to a low-security prison.

"We are hoping a sentencing date will be set before Christmas."

"As a 25-year-old who doesn’t know anybody out here, aside from her boyfriend, it will be terrifying."

Kemp will remain in custody until October 31, when a date will be set for sentencing.
