A grand jury is set to be gathered to hear fresh evidence as part of criminal accusations for the inception of the "Russia collusion hoax".
On Monday, Attorney General Pam Bondi signed an order to direct a US prosecutor to gather a grand jury.
Bondi's move comes following Director of National Intelligence Tulsi Gabbard submitting criminal referrals for former President Obama and his officials to the Justice Department.
The officials involved in the referrals include former CIA Director John Brennan and ex-Intelligence Chief James Clapper.
Gabbard revealed evidence which claims that Obama's team coordinated illegally to link Donald Trump to Russia in the run up to the 2016 presidential election.
The order, signed by Bondi on Monday, comes after FBI Director Kash Patel revealed that he had discovered a series of documents linked to the Russia investigation in a secret room at the bureau.
Patel claimed that these documents were found in bags that were supposed to be burned.
The documents were published by Republican senator, Chuck Grassley and contain an annex to former Special Counsel John Durham's final report on the start of the FBI's investigations into the 2016 Trump campaign.

Critics hit out at Bondi for releasing the documents, claiming that it was a distraction for the mishandling of the Epstein files review which saw the Attorney General face calls to stand down.
Bondi's decision to sign the order on Monday marks the Trump administration ramping up its action in charging Obama and his officials with criminal offences.
Special Counsel John Durham examined the FBI's investigation into the alleged links between Trump's 2016 campaign officials and Russia.
Durham concluded that the FBI did not have enough information to launch an investigation at the time.

Last week, Brennan and Clapper refuted claims that the Obama administration's intelligence arms were politicised.
In a piece for the New York Times, they wrote: "The special counsel John Durham, who was appointed during Mr. Trump's first term to investigate how the Russia probe was conducted, similarly found no evidence of an Obama administration conspiracy against Mr. Trump."
The annex written by Durham highlighted Clinton's attempts to tie Trump with Russia and show failures from the FBI in investigating Clinton's involvement with the collusion claims.
Last month, Trump's administration published hundreds of other documents relating to the Russian collusion allegations.
Gabbard claims that the evidence she declassified proves the Obama administration had "manufactured and politicised intelligence" to make it seem that Trump's 2016 election win was influenced by Russia and bad actors.
The Director of National Intelligence claimed that some individuals within the intel community did not want the documents to "see the light of day".
She said: "There are a lot of deep state actors still here within Washington. President Trump wants us to find the truth. I want to find that truth. The American people deserve the truth, and they deserve accountability."
