The Biden administration, following up on the work of the Obama administration, has managed to free nearly every Al Qaeda terrorist from Gitmo.

Last year, I warned that Biden was trying to finish the job of closing Gitmo by cutting a deal with Khalid Sheikh Mohammed, the mastermind of 9/11, and a few Jihadists even worse than the one above, whom even the current administration doesn’t feel quite ready to straight-up release in an election year.

Khalid Sheikh Mohammed, the architect of the September 11 attacks, not to mention multiple other plots and acts of terror including the 1993 bombing of the World Trade Center and the brutal murder of Daniel Pearl, was captured in March 2003.

19 years later the trial has yet to go anywhere.

Attorney General Eric Holder had promised that Mohammed would receive the death penalty. Numerous politicians, both Democrats and Republicans, assured 9/11 families he would. But Mohammed understood that, like his Taliban allies, all he had to do was wait out America.

And now the waiting is nearly over and 9/11 families, whom Biden already robbed of a settlement from a lawsuit that he redirected to the Taliban, are being notified of the dirty deal that’s coming.

The Pentagon and FBI have notified some of the families of victims of the 9/11 attacks that suspected terrorist mastermind Khalid Shaikh Mohammed and four other defendants could be spared the death penalty under plea agreements being considered by the Biden administration.

The notice came in the form of a letter, obtained by the Associated Press, that was sent to 9/11 families as the government explores how to resolve the more than decade-long prosecution of the alleged terrorists.

“The Office of the Chief Prosecutor has been negotiating and is considering entering into pre-trial agreements,” the letter informs families, adding that while no plea agreement “has been finalized, and may never be finalized, it is possible that a [pre-trial agreement] in this case would remove the possibility of the death penalty.”

Despicable and inevitable. After 20 years, there’s still no trial and there is a plea deal. Compare this disgrace to how we did it in WWII.

In 1942, with the war underway, Nazi saboteurs brought here by submarine were arrested by the FBI. They were caught in June, tried in July, and sent to the electric chair in August.

And that was for enemy operatives who had not even managed to kill a single American.

Meanwhile after 19 years of having the mastermind of the murder of thousands of Americans in custody, he has yet to be convicted and is unlikely now to pay the price for his crimes.

The question is how long after the plea deal will we be told that KSM is sick and we should just release him to the Saudis or Qataris where they’ll keep him out of trouble?

“How can you have any faith in it?” Jim Riches, a retired deputy fire chief in New York City who lost his son Jimmy — also a firefighter — on Sept. 11, 2001, told the Associated Press about the government’s update.

“No matter how many letters they send, until I see it, I won’t believe it,” Riches said about the prospect of justice for his son’s death, lamenting that “those guys are still alive. Our children are dead” nearly 22 years after the attacks.

Peter Brady, whose father was killed in the attack, received the letter this week and said the case “needs to go through the legal process.”

It’s about “holding people responsible, and they’re taking that away with this plea,” Brady told the Associated Press.

Frankly, those “people” needed to be pumped for everything they had abroad, then hung from the nearest palm tree. Instead the Bush administration let itself be talked out of doing the right thing, the military trials system was revived, but the people involved in it are not patriots and began playing procedural games. The trials went nowhere even as law firms, some paid by the Saudis, some just consisting of leftists, eagerly swarmed to defend Al Qaeda and Taliban jihadis pro-bono. And now here we are.

This is why drone strikes make sense. It’s also why it’s a good thing that Osama didn’t surrender. Biden would be offering him a plea deal too.

Any kind of normative legal system makes no sense for enemy combatants taken prisoner abroad who don’t follow the laws of war. The standard approach to such insurgents is that they can be killed out of hand.

Period.

The laws of war do not apply to terrorists. The only reason to take prisoners is to obtain information. After that, finish the job, don’t do it on American soil or any territory we legally control to limit the lawfare.

We had the opportunity to do these things after 9/11 when we were united in our resolve, when we knew who the enemy was, and before we had collapsed into schizoid infighting and endless conspiracy theories. Now it will take something even worse than 9/11 to wake us up. Or the even more horrific prospect that there won’t be a climatic event, instead, like Europe, we’ll be slowly devoured by mass terror migration.

And our politicians, like Biden, will openly serve the enemy.
