Peña, who ran for District 14 of the New Mexico House of Representatives in November 2022, had allegedly organised the shootings after visiting the homes of Bernalillo County commissioners to urge them not to certify the election results. Peña faces a mandatory minimum of 60 years in prison if convicted of the charges, however, he has denied any involvement in the shootings against Democratic politicians.

Peña was charged along with co-conspirators Demetrio Trujillo and Jose Trujillo, who also faced several firearm offenses. The DOJ claimed that Peña had allegedly urged officials not to certify the election results as he considered it rigged against him. The shootings were carried out between the fourth of December 2022 and the third of January. No one was injured in the shootings, however, several shots passed through the bedroom of Democratic state Sen. Linda Lopez’s sleeping daughter. Peña is currently being held without bail.

Many statehouses are now turning their attention to foreign affairs, even though historic factors have meant that for much of their history, siting and legislating on local issues was the main focus of statehouses, with national policies being followed as a matter of course. Today, with 39 states controlled by a single party, it has become easier to pass legislation, and both Republican and Democratic statehouses now use these bills to register discontent with the federal government's failure to act on certain issues. However, these bills have real consequences, particularly for foreign relations, given that America's states are pursuing their own foreign policies, which could have impacts that stretch well beyond individual states.

Four suspects aged between 16 and 19 years old have been charged with murder and robbery in Preston's death. They were also charged with five other armed robberies that same evening, a carjacking and, in one suspect's case, felon in possession of a firearm. All four had lengthy rap sheets, and none had jobs or had finished high school, according to prosecutors.
