The organization is permitted to move forward with its lawsuit to acquire data reports.

The President made the same false claim last year during a speech in Colorado to designate Camp Hale as a national monument. Although Beau did serve in Iraq, he died of brain cancer in 2015. This and other gaffes have fueled concerns about Biden's mental health and age, with a Yahoo News/YouGov poll showing that a strong majority of Americans have doubts about his mental acuity and ability to serve as President.
