Former President Donald Trump said Tuesday afternoon he believes Justice Department Special Counsel Jack Smith’s office will release an indictment against him at 5 p.m., as a Washington, D.C. grand jury is weighing charges against Trump in connection with his conduct leading up to the January 6 Capitol riots.

Trump made the claim on Truth Social hours after the grand jury concluded meeting for the day Tuesday, according to multiple reports.

It’s not clear why Trump believes he will be indicted Tuesday or whether his prediction will come to pass—Smith’s office still hasn’t publicly disclosed an indictment.

Trump predicted Monday he would be indicted “any day now” after his lawyers met Thursday with Smith’s office and he said on July 18 he received a target letter from the Justice Department indicating a forthcoming indictment in its January 6 probe.

It’s unclear what charges Trump could face, but the target letter indicated he could be charged under a Civil War-era statute that prohibits people from intimidating or threatening others in an effort to prevent them from exercising their constitutional rights, the New York Times reported.

On Truth Social, Trump questioned why the probe took so long and suggested without evidence that the Justice Department purposely waited in order to “put it right in the middle of [his] campaign.”
