State prosecutors requested to drop three counts of aggravated sexual battery against Mahomes, according to Johnson County, Kansas court records, though Mahomes would still face a fourth charge for misdemeanor battery.
The Johnson County District Attorney’s Office said in court documents the alleged victim, Aspen Vaughn, has refused to cooperate with law enforcement and indicated she would not cooperate with the prosecution, according to USA Today.
The prosecution intends to move forward with the misdemeanor case despite Vaughn’s refusal to testify or cooperate, according to the Associated Press, adding a surveillance video captured the incident between Vaughn and Mahomes.
Mahomes—who faces up to 55 months in prison if the charges are upheld—would face up to six months in prison and a $1,000 fine if found guilty of misdemeanor battery.
Mahomes is scheduled to appear in court Wednesday for a preliminary hearing for all four charges, according to USA Today.
Mahomes, a social media influencer with more than 1 million followers on TikTok and 250,000 followers on Instagram, was arrested in May 2023 on sexual battery charges. The arrest stemmed from a February incident caught on camera, in which Mahomes grabbed Vaughn by the neck and kissed her, according to the Kansas City Star. Mahomes was subsequently released on a $100,000 bail. Brandon Davies, Mahomes’ attorney, suggests the video “does not provide proper context.”
Vaughn, who owned the Aspens Restaurant and Lounge in Overland Park, Kansas, told the Kansas City Star she closed the restaurant in August after she and other staff were harassed and received death threats. The restaurant was also vandalized after Mahomes was charged, Vaughn said.
