New Mexico prosecutors may recharge Alec Baldwin for his involvement in the 2021 fatal Rust shooting, sources familiar with the matter told NBC News on Tuesday, months after prosecutors dropped charges against the actor.
Baldwin previously had his involuntary manslaughter charges dropped in April.
New Mexico prosecutors reportedly intend to recharge Baldwin with involuntary manslaughter for his involvement in the deadly shooting that killed cinematographer Halyna Hutchins on the set of the movie Rust in October 2021.
Prosecutors will present the case to a grand jury in mid-November, a source told NBC News.
New Mexico prosecutors did not immediately respond to Forbes’ request for comment and attorneys for Baldwin declined to comment.
A plea deal has been part of recent discussion, two unnamed sources familiar with the matter told NBC News.
- That’s how many months Baldwin could face behind bars if he’s convicted.
In April, special prosecutors Kari Morrissey and Jason Lewis dismissed the manslaughter charges against Baldwin. At the time, prosecutors said there was a chance Baldwin could be recharged. Baldwin—who was initially charged with two counts of involuntary manslaughter after a two-year investigation into the shooting that killed Hutchins and injured director Joel Souza—previously pleaded not guilty. Baldwin has maintained that he did not pull the gun’s trigger and he believed the gun to be safe. Hutchins was killed with live ammunition, which was not supposed to be on the set of the film. But, before dropping the charges, protestors argued that Baldwin had his finger on the trigger in photos and videos from the set.
Hannah Gutierrez Reed, who was the film’s armorer, also faces involuntary manslaughter charges for her role in the case. While Baldwin had his charges dropped in April, prosecutors did not drop Gutierrez Reed’s charges. Her trial is set for February 21.
