Deja Taylor, the 26-year-old mother, was charged by a Newport News, Virginia, grand jury in April, and also faces a misdemeanor charge of recklessly leaving a loaded firearm to endanger a child.

Taylor could serve up to six months in state prison if convicted, multiple outlets reported.

Taylor’s 6-year-old boy was not charged after leaving his teacher, Abigail Zwerner, with “life-threatening” injuries.

Zwerner filed a $40 million lawsuit against the Richneck Elementary School administration in April, claiming the school’s former principal and assistant principal, as well as its former superintendent and school board, ignored warnings that the student planned to shoot his teacher with the gun and failed to report the weapon.

This is a developing story and will be updated.
