


A New York City judge on Wednesday declined to dismiss the case against Daniel Penny—the Marine veteran accused of placing 30-year-old Jordan Neely in a fatal chokehold last year on a city subway—multiple news outlets reported.

Defense attorneys for Penny requested the dismissal in October after he entered a not-guilty plea in June in New York’s Supreme Court in Manhattan, following a grand jury’s indictment for second-degree manslaughter and criminally negligent homicide.
Penny will return to court on March 20, with the trial set to begin in the fall, FOX 5 NY reported.
