President Joe Biden’s son Hunter Biden sued attorney Rudy Giuliani and his lawyer in federal court Tuesday, accusing them of “annihilat[ing]” his data and digital privacy by tampering with his laptop and data—the latest twist in an ongoing saga over Biden’s laptop, three years after it became a source of election year controversy pushed by Giuliani and others on the right.

Biden sued Giuliani and several limited liability companies he owns, along with Giuliani’s attorney Robert Costello and 10 unnamed individuals, accusing them of violating the Computer Fraud and Abuse Act, California Computer Data Access and Fraud Act and rules against unfair business practices.

The lawsuit takes issue with Giuliani and Costello’s possession of Biden’s “laptop”—which the lawsuit notes is not an actual laptop, but rather “an ‘external drive’ that Defendants were told contained hundreds of gigabytes of Plaintiff’s personal data”—which the defendants have allegedly illegally hacked and tampered with, making “further alterations and damage to the data.”

After being given a copy of Biden’s digital data by John Paul Mac Isaac, who worked at the computer store where Biden dropped off his laptop and never picked it up, Giuliani and Costello allegedly “repeatedly accessed Plaintiff’s account to gain access to the drive; and they proceeded to tamper with, manipulate, alter, damage and create ‘bootable copies’ of Plaintiff’s data over a period of many months, if not years,” the lawsuit says.

Giuliani repeatedly “bragged” about copying and sharing Biden’s data and loading it onto other devices in public podcasts and interviews, the lawsuit alleges, and invited other people to access and manipulate the data.

The lawsuit says Biden never authorized or consented to Giuliani or anyone else accessing his data, and the defendants “gained unlawful access to Plaintiff’s data by circumventing technical or code-based barriers that were designed and intended to prevent such access.”

Giuliani’s spokesperson Ted Goodman and Costello have not yet responded to requests for comment.

“Although Defendants and their allies are entitled to their baseless opinions about Plaintiff and the Biden family—and they are also free to share those opinions on their podcasts and with whomever else cares about what they have to say—they are not entitled to violate federal and state anti-computer hacking laws to advance their personal and political agendas,” the lawsuit states. “Yet that is precisely what they have been doing with impunity, and what they will continue to do absent judicial relief.”

The lawsuit asks for a jury trial and an injunction that bars the defendants from accessing or tampering with Biden’s data and forces them to restore any hard drives or other property they have with Biden’s data to the president’s son. It also asks for an unspecified amount in damages, though the lawsuit notes the amount of damages Biden has suffered exceeds $75,000.
