


A Georgia judge denied former President Donald Trump and his co-defendants’ request to dismiss an election-racketeering case—in which the former president and his co-defendants are accused of attempting to overturn the results of the last presidential election—and claimed it did not violate the first amendment as the defendants asserted it did.
Trump and his co-defendants argued the state of Georgia’s prosecution violated their first amendment protections but Judge Scott McAfee ruled against that argument Thursday saying “these vital constitutional protections do not reach the actions and statements alleged by the State.”
In August, Trump and his 18 co-defendants were indicted on racketeering and conspiracy charges related to an alleged plot to overturn the results of the 2020 election.
