


A grand jury has indicted Daniel Penny, a former U.S. Marine who held Jordan Neely in a fatal chokehold on a New York City subway train in May, ABC News reported Wednesday—though the charges Penny was indicted on have not yet been unsealed.

Penny, 24, was arrested last month and faces a second-degree manslaughter charge in the killing of Neely, a 30-year-old homeless man whose death was previously ruled a homicide, which set off city-wide protests after video surfaced of the chokehold.
Penny was released on a $100,000 bond.
The charges will not be unsealed until a later date when Penny appears in court, law enforcement sources told ABC News.
Penny’s lawyers argued after Neely’s death that Penny “never intended to harm” Neely.
