A federal appeals court on Tuesday extended the temporary injunction preventing Texas from implementing S.B. 4, the controversial bill that would allow the state to arrest migrants suspected of crossing the border illegally.
The court will hear arguments on the law’s constitutionality on April 3.
A panel of three judges on the Fifth Circuit Court of Appeals voted 2-1 to keep the injunction in place, mirroring the decision last week; only Judge Andrew Oldham, a Trump appointee, dissented.
Texas could appeal the decision to the Supreme Court, who previously ruled that the law could go into effect before it was blocked again by the appeals court on March 20.
The appeals court will hear arguments on the constitutionality of the law on April 3.
This is a developing story.
